Chapter 9 - The Courtroom Pre-Trial Showdown

Monday morning arrived under a relentless, freezing Chicago rain.

The corridors of the Richard J. Daley Center were choked with damp wool coats, hurried attorneys, and the hum of fluorescent lighting bouncing off terrazzo floors. Courtroom 1804 was packed to capacity for the emergency motions docket.

I sat at the plaintiff's counsel table wearing a sharp, charcoal-gray bespoke wool suit, my hair pulled back into an immaculate, low chignon. Beside me sat Arthur Vance and Elena Cruz, their laptops open and stacks of color-coded exhibits arranged in military precision.

Across the aisle, at the defense table, the scene was entirely different.

Ryan was wearing the same rumpled suit from forty-eight hours ago. He looked emaciated, dark violet shadows bruising the skin under his sunken eyes. His hands trembled so violently he couldn't keep his legal pad flat against the table. Sitting beside him was a sweating, disheveled attorney named Marcus Gable—a strip-mall practitioner whose briefcase had a broken latch held together with black electrical tape.

Sitting in the front row of the gallery directly behind Ryan was Linda Collins, her face set in a mask of rigid defiance, flanked by Tyler, who kept shifting uncomfortably in his seat and checking the courtroom doors.

"All rise!" the bailiff boomed. "The Circuit Court of Cook County, Domestic Relations Division, is now in session. The Honorable Judge Evelyn Ward presiding."

Judge Ward, a formidable African-American woman in her sixties with silver-streaked hair and eyes that had seen every low-rent scam in the city, took the bench and adjusted her half-moon spectacles.

"Collins versus Collins," Judge Ward announced, her voice echoing in the wood-paneled room. "Emergency petition for interim relief, exclusive possession, and verification of asset restraint. Mr. Vance, you represent the petitioner. Proceed."

Arthur Vance stood up, buttoning his jacket with slow, deliberate precision.

"Your Honor, thirty-six hours ago, petitioner Sarah Collins uncovered a coordinated, fraudulent scheme perpetrated by the respondent, Ryan Collins, in active conspiracy with third parties, including members of his immediate family."

"Objection!" Marcus Gable barked, stumbling to his feet. "Your Honor, this is an unconscionable smear campaign! My client is a victim of a corporate misunderstanding involving a failed restaurant venture! His wife has locked him out of his own home, frozen his personal checking accounts, and left him literally destitute on the street without due process!"

Judge Ward didn't even look up from her paperwork. "Mr. Gable, if you interrupt Mr. Vance again before he concludes his opening statement, I will hold you in contempt before the coffee in my mug gets cold. Sit down."

Gable collapsed back into his chair, wiping his forehead with a handkerchief.

"As I was saying, Your Honor," Arthur continued smoothly, walking toward the center podium. "We have submitted under seal an emergency proffer containing sworn testimony, encrypted messaging logs, and forensic banking documentation. These records demonstrate that respondent Ryan Collins forged the petitioner's signature on a $100,000 commercial liability guarantee."

Arthur stepped forward and laid a thick binder on the bench before the judge's clerk.

"Furthermore, the forensic handwriting analysis certified by independent state-licensed examiners confirms the forgery. But that is merely the beginning. We have established that Mr. Collins, in concert with his brother Tyler Collins and his mother Linda Collins, systematically laundered over $160,000 of marital funds into an offshore shell entity registered in Belize under the name *Seaside Management Ltd*."

A sharp, audible gasp ripped through the gallery.

Judge Ward’s eyes snapped up from the documents, locking onto Ryan, who buried his face in his hands and began to shake.

Behind him, Linda Collins stood up from the gallery bench, her face purple with indignation. "That is an outrageous lie! I am a sick woman! Sarah gave me that money out of the goodness of her heart!"

*BANG!*

Judge Ward slammed her gavel down with thunderous force.

"Deputy! Remove that woman from my courtroom immediately!"

"You can't do this!" Linda shrieked as two armed bailiffs converged on her, grabbing her arms and hauling her toward the heavy double doors. "Ryan is the victim! She’s trying to destroy my family! Ryan!"

The heavy oak doors clicked shut behind her, cutting off her screeching protests. The courtroom fell into absolute, suffocating silence.

Judge Ward turned her gaze back to the defense table, her voice dropping into a register that made even Marcus Gable cringe.

"Mr. Gable. Does your client dispute the authenticity of the Great Lakes National Bank loan documents bearing petitioner's purported signature?"

Gable leaned over to whisper frantically into Ryan's ear. Ryan shook his head, weeping silently into his sleeves, unable to speak.

"Your Honor," Gable stammered, his face pale. "My client... on the advice of counsel, asserts his Fifth Amendment privilege against self-incrimination regarding the loan execution."

Judge Ward’s expression hardened into granite.

"In a civil proceeding, Mr. Gable, this court is entitled to draw an adverse inference from your client’s refusal to answer. And that inference is that he committed aggravated identity theft and financial fraud against his own spouse."

Judge Ward picked up her pen and began signing orders with sharp, rhythmic strokes.

"Here are the court’s rulings. The emergency order granting petitioner exclusive possession of the marital condo on Lincoln Park West is affirmed and extended indefinitely. Respondent Ryan Collins is ordered to surrender any and all keys, access fobs, and garage openers immediately to the bailiff."

"Your Honor—" Ryan choked out, finally lifting his ruined face. "Where do I live?"

"That is of zero concern to this court, Mr. Collins," Judge Ward snapped. "You may reside at a shelter or with your associates. Furthermore, the statewide freeze on all personal and business accounts associated with Ryan Collins, Tyler Collins, and *Seaside Management Ltd* within the jurisdiction of Illinois is confirmed and expanded."

She looked directly at Tyler Collins, who was still sitting in the gallery, frozen in terror.

"Tyler Collins," the judge said, her voice echoing off the high ceilings. "I am ordering an immediate emergency deposition under subpoena for your appearance in this court on Thursday at 9:00 a.m. to show cause why you should not be held in civil contempt for dissipation of marital assets. If you attempt to board an aircraft or transfer funds out of that Belize entity, a bench warrant for your arrest will be issued before you reach the airport security line."

Tyler looked like he was going to vomit. He stood up on wobbly legs and practically bolted out of the courtroom doors.

"Finally," Judge Ward concluded, turning her gaze back to me. Her severe expression softened, if only by a fraction of an inch. "Mrs. Collins, the court refers this matter immediately to the Financial Crimes Division of the Cook County State's Attorney and the United States Attorney's Office for the Northern District of Illinois. This court will not be used as an instrument to shield criminal predators who hide behind marriage certificates."

She struck the gavel once.

"Court is adjourned."
